How can I register a Domestic Partnership?

Registering a Domestic Partnership may allow you and your partner to qualify for family discounts, employee benefits, health benefits, and may open the door to legal benefits previously difficult or impossible to obtain for unmarried couples in close, committed relationships. 

The Office of the Westchester County Clerk can assist you in registering your Domestic Partnership. You will need to (1) Establish that you are eligible to register; (2) Complete an Affidavit of Domestic Partnership Registration; and (3) file your affidavit and fee in the Office of the Westchester County Clerk. To be eligible to register as Domestic Partners in Westchester County
(1) The partners must reside in the County of Westchester, or one partner must be employed by the County of Westchester.  (2) Each partner must be eighteen years of age or older, unmarried and competent to enter into a contract.  (3) The partners must not be related by blood in a manner that would bar marriage under the laws of the State of New York.  (4) The partners must share a common household.  (5) The partners must be in a close and committed, financially interdependent personal relationship and intend to remain in the relationship.  (6) The partners must be each other's sole domestic partner, have no other domestic partner and intend to remain each other's sole domestic partner.  (7) Neither partner can have had a termination of a domestic partnership become effective within the last sixty calendar days.  (8) The partners must agree to file a termination statement in the event that the domestic partnership is terminated.

The Affidavit of Domestic Partnership Registration
Complete the Affidavit of Domestic Partnership Registration or pick one up in the Legal Division of the County Clerk's office at 110 Dr. Martin Luther King, Jr. Boulevard, Room 330, White Plains, NY 10601. When filling out the affidavit, please be sure the names of both partners and their home address are clearly printed. Both partners must sign the affidavit and the signatures of each partner must be notarized. If eligibility to register is based on employment by the County of Westchester, the name of the county department in which one partner is employed must be clearly stated.

To file your Affidavit in the Office of the Westchester County Clerk
If you are filing in person, a staff member is available to serve as Notary Public as long as you provide valid identification.  If you are filing by mail, please be sure the Affidavit of Domestic Partnership Registration has been properly completed and notarized.  In addition, please include as self-addressed stamped envelope.  There is a $35.00 filing fee payable by cash, certified check or money order payable to the "Westchester County Clerk".  In addition, if you are filing in person, payment may be made by American Express, Discover, MasterCard or Visa.  You will receive two certified copies of the affidavit submitted, along with a Certificate of Domestic Partnership.  Our office is located at 110 Dr. Martin Luther King, Jr. Blvd., Room 330 in White Plains and can be reached by entering through the Richard J. Daronco Courthouse at 111 Dr. Martin Luther King Jr. Blvd. The office is open Monday through Friday, excluding County holidays, from 8:30 a.m. until 4:30 p.m. 

To Terminate a Domestic Partnership
If your Domestic Partnership comes to an end, you are required to file a Termination Statement in the Office of the Westchester County Clerk.  Once completed, the Termination Statement can be filed in person or by mail.  If you are filing in person, a staff member is available to serve as a Notary Public as long as you can provide valid identification.  If you are filing by mail, please be sure the Termination Statement has been properly completed and notarized.  In addition, please include a self-addressed stamped envelope so that we can return a certified copy to you.  The fee to file your Termination Statement is $35.00.  Payments can be made using cash, certified check or money order payable to the "Westchester County Clerk".  In addition, if you are filing in person, payment may be made by American Express, Discover, MasterCard or Visa.  Our office is located at 110 Dr. Martin Luther King, Jr. Blvd., Room 330 in White Plains and can be reached by entering through the Richard J.
