Judgments and Liens

Monetary judgments, mechanic's liens, broker's liens and notices of pendency can be searched in our White Plains office or at Westchester Records Online. As required by New York State Law, judgments and liens are permanent records accessible by the public. As these documents and filings are indexed by name, you must know and search by a debtor's last name.  Each judgment or lien entry will contain information about the original filing as well as any subsequent filings such as satisfactions and renewals. Note that judgments are enforceable against real property for ten years and twenty years against personal property.

In addition to searching our general index, weekly reports detailing the latest judgments and liens are available for purchase online in the Office of the Westchester County Clerk. Transcribed judgments from other New York State counties, Foreign Judgments and New York State Tax Warrants filed in our office are included. A separate section of the report contains Declaratory Judgments as issued by the court. Review a sample report to become familiar with what information will be provided to you if you subscribe. Enrolling in our Subscription Services allows a registered user to view cumulative weekly reports as well as weekly updated reports containing the latest filings from their personal computer for an annual fee of $750.00. However, if you are not enrolled in our subscription services, you can still obtain a copy of weekly judgment and lien reports for a fee of $30 per weekly printout. 

To obtain the weekly report, use Westchester Records Online or visit our office, located at 110 Dr. Martin Luther King, Jr. Blvd., Room 330 in White Plains which can be reached by entering through the Richard J. Daronco Courthouse at 111 Dr. Martin Luther King Jr. Blvd. The office is open Monday through Friday, excluding legal holidays, from 8:30 a.m. until 4:30 p.m. If you would prefer to request the report by mail, please be sure to include a check or money order payable to the "Westchester County Clerk" in the amount of $30.00 per weekly list as credit cards and cash are not accepted via mail.  Please include a self-addressed stamped envelope in which your list can be returned.

Foreclosures

As foreclosure increases in Westchester County follow national trends, County Clerk Timothy C. Idoni urges Westchester residents who may be at risk of having their properties foreclosed, to seek counseling from a reputable counseling agency.  Residents who have received warning letters from their bank or lender, or who have fallen behind on their payments, should contact the Department of Housing and Urban Development (HUD) to obtain the name of a reputable counseling agency. A list of agencies can be obtained from the HUD website or by calling 1-800-569-4287. If a foreclosure action has been brought against you, beware of foreclosure rescue scams.  Making a bad situation worse can be avoided by relying on a reputable counseling agency or a trusted attorney to guide you through the process.  Residents who meet low income guidelines may qualify for free legal services and should visit LawHelp for more details.

The commencement of a foreclosure action does not mean that a Westchester home will be lost to foreclosure.  Filing a foreclosure action in the Westchester County Clerk’s office is the first step of a process which could result in the loss of a home or building.  If a foreclosure is granted, the home or building is sold at a foreclosure auction and the proceeds of sale are used to pay off the loan.  Many homeowners enter into a repayment plan, secure a modified loan, refinance with another lender or sell their home on their own to avoid foreclosure.

The Westchester County Clerk is the Clerk for the Supreme Court where foreclosure actions are heard.  Foreclosure actions are filed in our Legal Division. The public can visit the Legal Division located at 110 Dr. Martin Luther King Jr. Blvd. in White Plains between the hours of 8:30 a.m. and 4:30 p.m., Monday through Friday, excluding legal holidays to look up legal records, judgments, liens, lis pendens, and other business records.

The Office of the Westchester County Clerk provides weekly foreclosure lists which contain data from recently commenced actions including mortgagor, mortgagee, property location and a reference to the pending court action. Please feel free to view a Sample Report to become familiar with what information can be provided to you. Further examination of pending court cases can be conducted either in person or via the online search feature of the County Clerk website. However, if you are not enrolled in our Subscription Services, you can still obtain a copy of weekly foreclosure reports for a fee of $20.00 per weekly printout. SCAR Petitions

How do I file a Small Claims Assessment Review (SCAR) Petition?

SCAR stands for "Small Claims Assessment Review" and refers to the process which allows owner-occupants of residential property to file a court case to challenge a tax assessment.  This can only be done after a property tax assessment grievance has been turned down by the local Board of Assessment review. If you have not already filed with a local Board of Assessment Review, please check with your local tax assessor to learn the dates by which your grievance must be filed on the local level.

The SCAR process is an alternative appeal process for residential property to a formal Tax Certiorari proceeding and provides for review before a Hearing Officer in an informal setting.  Your SCAR petition must be filed within 30 days of the filing of the final assessment roll in your community.  Each community may have a different assessment roll date, so please be sure to confirm the date with the municipality in which the property is located.  If the petition is filed more than 30 days after the filing of the assessment roll, your petition may be dismissed.

If you are Homeowner filing on your own behalf:

Complete and sign a Small Claims Assessment Review (SCAR) Petition (OCA Link). You can fill it in online and print it to affix your signature.  Instructions for completing the petition (OCA Link).

Next, you will need to use the New York State Courts E-Filing System (NYSCEF) to create an e-filing account and e-file the petition.  Visit www.nycourts.gov/efile and click CREATE ACCOUNT to apply for your NYSCEF user ID. You can click the link for Unrepresented Litigants for instructions for non-attorneys on creating an account and using NYSCEF. Complete the online application and then log into NYSCEF using your User ID and Password.

  • In NYSCEF, go to “Start a New Case”
  • Select “Westchester County Supreme Court” as the court.
  • Select “Small Claims Assessment Review” as the case type.
  • Input party names. The homeowner is the Plaintiff/Petitioner. The municipality in which the taxes are being grieved is  the Defendant/Respondent, which will be typed into the “Business/Organization Name” field. (for example: “White Plains City of” or “Yonkers City of”
  • Select “SCAR Petition” as the commencement document and attach the pdf of the petition that you have filled out and signed.
  • You will pay your $30.00 filing fee online via credit card (Visa, Mastercard, American Express).

After filing your Petition in NYSCEF:

  • County Clerk staff will review your Petition to ensure that it is complete and assign your Petition an Index Number. You will receive an e-mail notification that your Index Number has been assigned (generally within a few hours after submission during business hours) and you will be able to access a File Stamped copy of your SCAR Petition immediately in NYSCEF.
  • Within ten days after filing your Petition in the NYSCEF site, you must deliver copies of your petition in accordance with Real Property Tax Law § 730.  For further details, please see the Unified Court System's Small Claims Assessment Review General Information and Filing Requirements (UCS 900) (OCA Link).

Please note:

If you are an Authorized Agent filing on behalf of multiple homeowners:

Ensure that you have a complete and fully executed Small Claims Assessment Review (SCAR) Petition for each homeowner/property.

Complete the application for your NYSCEF Filing Agent user ID.

You may fax your completed form to the E-filing resource Center at (212) 401-9146. You may also e-mail your completed application to the E-filing resource Center at This email address is being protected from spambots. You need JavaScript enabled to view it.

Once the application process is complete and you have obtained your NYSCEF Filing Agent ID you may proceed. There may be a 24-48 hour processing period.

  • In NYSCEF, go to “Start a New Case” 
  • Select "Westchester County Supreme Court" as your court.
  • Under the "Real Property" section, select “Other Real Property” and "SCAR" as the case type.
  • Input petitioner names. The homeowner is the Plaintiff/Petitioner. The municipality is the Defendant/Respondent, which you can select from the drop-down menu.
  • Select “SCAR Petition” as the commencement document and attach the pdf of the petition that you have filled out and signed.
  • You will pay your $30.00 filing fee online via credit card (Visa, Mastercard, American Express). The Westchester County Clerk has also implemented ACH Debit Accounts as another payment option

After filing your Petition in NYSCEF:

  • County Clerk staff will review your Petition to ensure that it is complete and assign your Petition an Index Number. You will receive an e-mail notification that your Index Number has been assigned (generally within a few hours after submission during business hours) and you will be able to access a File Stamped copy of your SCAR Petition immediately in NYSCEF.

Criminal Dispositions

If the conviction occurred in the Westchester County Court, you may come into the Westchester County Clerk’s Office personally or you can submit a request via mail. If you are submitting a request through the mail, please provide the name of the Defendant and the approximate date the action took place. The fee for a certified copy of the Sentence & Commitment (“Certificate of Disposition”) is $5.00. If you are submitting your request by mail, please include a check or money order payable to the “Westchester County Clerk”. An additional $5.00 search fee will apply if you do not know the Indictment Number and are submitting the request by mail.

Please note that some criminal records are sealed by the New York State Criminal Procedure Law, Civil Rights Law, or any other applicable statutes and access may be limited or denied.
